Abstract(in English) | This article analyzes the concepts of copyright and authorship in the production, distribution, and exploitation of information in academia contained in copyright law and academic conventions and ethics. Copyright law prescribes the limitations of copyright and states cases in which copyright is limited to certain degree in order to promote the production, distribution, and exploitation of information in academia. However, not all information produced, distributed, or used in academia comes from copyrighted works whose use is regulated by copyright law, and the customs and conventions of the distribution and exploitation of academic information sometimes are inconsistent with copyright law. Additionally, copyright law has not yet responded to the rapid, accelerating educational and social changes at university and colleges driven by technological, social, and economic advances and the need for efficient, effective educational and academic activities. In this article, we confirm that academic conventions and ethics are prioritized over copyright law within the education and research fields in order to manage the quality of academic information and to support various activities of the academic and educational community. We show that the risk of litigation over copyright law violations should be reduced by forging contracts and agreements among relevant interest groups on the utilization of copyrighted works in order to avoid hindering their necessary use in academia. |
