On the Copyright Problems of Classroom Movie and Sound Recordings : A Computer and Information Ethics Perspective

Abstract(in English) The development and spread of ICT have made us utilize classroom movie and sound recordings in the public interest, for instance, for improvements in educational methods like MOOCs and flipped classrooms, the realization of the "open school" policy, and so on. However, there are many unresolved copyright problems in relation to classroom movie and sound recordings. This article explores whether class lectures and classroom interactions are regarded as copyrighted works or works for hire and how we should deal with class lectures and copyrighted works used in classrooms within the Japanese copyright system. We conclude that the majority of class lectures or classroom interactions are instructors' copyrighted works or those belonging to instructors and learners, but not works for hire. We therefore need to agree on copyright issues with instructors and learners as well as with copyright holders of works used in classrooms. However, since we cannot easily obtain agreement with third parties, we may need to introduce fair use as a defense in the Japanese copyright system to promote the use of classroom movies and sound recordings.
