| 抄録(和) | 本稿においては、自己情報コントロールとしてのプライバシー概念について、その問題点と意義について検討する。理論的問題点として、個人がコントロールすべき情報の範囲、自己情報コントロール権と財産権の誤った類比、プライバシー概念の広さ、社会的規制の必要性の4点がある。実務的問題点としては、自己情報コントロールの実質性、ビッグデータにおける自己情報コントロールの限界、インターネット上の個人情報の制御困難性の3点がある。自己情報コントロールとしてのプライバシー概念の意義は、多様な人間関係の構築・維持である。 |
| 抄録(英) | This presentation examines the problems and significance of the concept of privacy as control over one's information. The theoretical problems are (1)the range of information a person should control over , (2) the incorrect analogy of the right of control over one's information and the property right, (3) the broadness of the concept of privacy, and (4) the need for social regulation for privacy protection. The Practical problems are (1) the actuality of consensus, (2) the limit of the control over one's information in "Big Data", and (3) the difficulty of control over personal information on the internet. The significance of the concept of privacy as control over one's information consists in its function for building and maintaining of various human relationships. |
