A recent trend in ethical and legal studies on privacy

Abstract(in English) This article discusses a recent trend in ethical and legal studies regarding privacy by examining the literature in this area. In the 2000s, influential scholars and commentators abandoned or rejected the definition or conceptualization of privacy that searched for one unifying common trait or denominator that characterized privacy in all privacy invasions. Instead, they began attending to the heterogeneous networks of phenomena and traits of different types of privacy, as well as the contexts in which the flow of information became instances of privacy invasion. For example, H. Nissenbaum, a computer ethicist, emphasized the social norms or rules governing the flow of personal information in distinct social contexts and named what made the information flow appropriate as "conceptual integrity." According to D. Solove, a legal professor, "privacy" is an umbrella term for a plurality of things. Solove proposed a new taxonomy of privacy invasions to replace Prosser's traditional taxonomy, to which we have referred when deciding if there should be a privacy invasion. We tend to depend on ready-made conceptualizations of privacy when implementing privacy policy or developing privacy technology. However, recent studies on privacy indicate that there might be risks to misunderstanding privacy phenomena if the ready-made definitions of privacy are blindly followed.
