Abstract(in English) At present, advanced and complicated tehonology, globalization, and Japan's strategy of becoming an IPR nation would invite huge number of patent holders in various technological fields, in which patent pools would draw the industry's attention as a tool to ease licensing burden, to develop standardization, and to promote technological growth. However, various problems have been identified in relation to patent pools, and yet to be solved. This paper clarifies the problems such as outsiders and hold-up, regarding patent pools being operated under the current law environment including Antimonopoly Act and guidelines on patent pools that was issued by JFTC, and points out that there could be a room to apply some duty to the member intending to withdraw from the patent pool in order to improve those problems.
