| 抄録(和) | インターネットは原則としてセルフガバナンスの下で、管理・運用されてきた。ドメイン名も同様である。セルフガバナンスとは自らの意志で統制することであり、「自律」「協調」に基づいて管理・運営することである。しかし、インターネットの発展による利用数の増大や悪用等のため、ドメイン名の管理をセルフガバナンスで行うことが困難となりつつある。本稿では、ドメイン名の管理において、セルフガバナンスで管理できる部分と、規制により管理すべき部分について検討した。ドメイン名の登録は迅速な登録・使用のため無審査で行うことが好ましいため、無審査によってセルフガバナンスを保つべき部分であり、一方、紛争解決の手段については公平な判断をするため、実体法等の規定が必要と結論付けた。 |
| 抄録(英) | Internet systems haves been managed and operated based on self-governance in general. Domain name system is one of such examples. Self-governance means self-control and management based on "cooperation" and "autonomy". However, as the internet users have increased because of the growth of the internet, the principle of the self-governance has been facing some difficulties, resulting in that it appears useless in some cases. This paper discusses the limitations of the self-governance and concludes, then, that the self-governance should be applied for application process of the domain names without examination, while actual disputes need to be resolved by the substantive laws from the viewpoint of the fair judgment. |
