| 抄録(和) | 人をさまざまな局面で支援しようとする機械の知能が高度になったことで,かえって人が窮地に追い込まれる事例が出現している.人と,人を支援しようとする技術との間にどのようなミスマッチが発生しているか,そして,そこで生じる人の失敗の責任を問う際に,法はときに人に厳しくあたることがあることを示したうえで,人を厳しい場面に追い込まないようにするにはどのような視点が求められるかを考察する. |
| 抄録(英) | Today's machines can sense and analyze a situation, decide what must be done, and implement control actions. Although it is true that such smart and autonomous machines contribute much to systems' safety, they sometimes bring negative side effects to humans, even when the machines are supposed to support the humans. This paper gives firstly an overview on various mismatches between humans and technologies, and then points out that criminal laws are often (too) strict to humans when their situation understanding, decisions, or actions are inappropriate in difficult circumstances. Some discussions are made on what types of considerations may be needed in order not to put the humans into difficult conditions. |
