Intellectual property and the North South problem

Abstract(in English) A patent system is a system of promoting development of industry and performing the contribution to society, by giving exclusive rights at an inventor to the collateral which exhibits invention during a fixed period. However, under today's complicated international relations, it may become a prevention factor to society conversely. In this paper, take up the example of the problem about manufacture of AIDS/HIV medicine, or bird influenza, and be involved with the North South problem about the balance of patentee's profits and a society's as a whole public benefit. Moreover, the state of the compulsory license about the essential patent concerning technical standards is also described.
