| 抄録(和) | 本稿では、大学等の教育研究機関において昨今実用段階に入りつつある遠隔講義について、著作権等の側面の問題点を論じている。大学等で行われる遠隔講義ではインターネットのような大規模ネットワークを介するため、技術的には夥しい数のユーザに対して講義配信が可能である。従来の大学での講義における他者著作物等の利用は私的利用の範囲として認められているが、一方でネットワーク経由での著作物等の私的利用は、乱用される危惧もあり制限される方向で法制度も整備されてゆくと考えられる。よって本稿では、遠隔講義をopenとclosed、academy oriented とbusiness oriented のような基準で分類し、これらの度合いによって従来の教室での講義の延長に属する遠隔講義と商品として扱われるべき教材とに分離して、前者に関しては著作物等の利用を私的利用の範囲で可能とする考え方を提案している。また、著作物等の私的利用が認められる基準を提案し、これらを組み合わせることにより遠隔講義を行う者と、権利保持者とが合意できる可能性について論じている。 |
| 抄録(英) | In this paper, we discuss the copyrights problems of distance learning, which is about to step into the practical stage in the universities and other educational institutions. Since many distance learning systems in the universities are carried out by way of the large scale network like the Internet these days, the lectures can be sent to tremendous users technically. Though the utilization of others' productions has been permitted for conventional lectures in universities as private fair use, on the other hand, we have misgivings about the abuse of private fair use of others' productions especially in the case of contents delivering by way of the Internet, and the legislation has been limiting such private fair use discretion. In this paper, we classify the types of distance learning from some points of view at first, then divide them into the cases belonging to the extension of conventional lecture and those belonging to the commercial teaching materials. And finally, we discuss the possibility that those who want to promote distance learning in universities and copyright holders or authors of contents materials reach agreement on the copyright problems of distance learning. |
