A Study on the Copyrights of Network Contents for Distance Learning

Abstract(in English) In this paper, we discuss the copyrights problems of distance learning, which is about to step into the practical stage in the universities and other educational institutions. Since many distance learning systems in the universities are carried out by way of the large scale network like the Internet these days, the lectures can be sent to tremendous users technically. Though the utilization of others' productions has been permitted for conventional lectures in universities as private fair use, on the other hand, we have misgivings about the abuse of private fair use of others' productions especially in the case of contents delivering by way of the Internet, and the legislation has been limiting such private fair use discretion. In this paper, we classify the types of distance learning from some points of view at first, then divide them into the cases belonging to the extension of conventional lecture and those belonging to the commercial teaching materials. And finally, we discuss the possibility that those who want to promote distance learning in universities and copyright holders or authors of contents materials reach agreement on the copyright problems of distance learning.
