A Consideration of Draft Revision of the Copyright Law Regarding Education and Forecasted Issues

Abstract(in English) On January 22, 2018, the Ministry of Education announced the "draft bill to amend part of the copyright law" as a "draft law submitted by the Ministry of Education in the 196th National Assembly." This draft amendment to the copyright law stipulates as part of "establishing restriction provisions, etc. on the usage rights in accordance with the informationalization of education (related to Article 35 etc.)," that, in the case of a person in charge of education at schools, etc., conducting public transmission of the contents, it is not necessary to seek permission to author/copyright owner each time, and the installer (user) of educational institutions pays a relevant compensation to the designated management organization (copyright owner). This paper examines and evaluates this copyright revision proposal mainly based on Article 35 etc. and considers the predictable issues for both authors/copyright owners and users (especially primary and secondary education) in the enactment and enforcement of this Cabinet Order. I propose some necessary measures to deal with and solve each issue.
