| 抄録(和) | IoT，ビッグデータ，人工知能などの発展により，現在，第4次産業革命が進行しており，これに伴って，ビッグデータに対応するためのデータ法が日本を含めた世界各国で整備された．わが国著作権法はデータそのものは著作権法上の著作物として認めないが，データベースの著作物は著作権法の保護が受けられる．データベースの著作物が成立するためには創作性の要件が求められることになるのだが，データベースの著作物に関する判例を検討して，創作性について考察した． |
| 抄録(英) | The progress in the internet of things, big data and artificial intelligence are the engines of the ongoing fourth industrial revolution, and therefore, the data law was enacted in Japan and other countries to deal with the big data. Under the copyright law in Japan, data per se is not copyrightable, but the work of database is copyrightable. The eligibility of copyright in the database involves the concept of the creation, and the relevant case law are analyzed to elucidate the standard of the creation requirement herein. |
