| Abstract(in English) | The progress in the internet of things, big data and artificial intelligence are the engines of the ongoing fourth industrial revolution, and therefore, the data law was enacted in Japan and other countries to deal with the big data. Under the copyright law in Japan, data per se is not copyrightable, but the work of database is copyrightable. The eligibility of copyright in the database involves the concept of the creation, and the relevant case law are analyzed to elucidate the standard of the creation requirement herein. |
