Abstract(in Japanese) (See Japanese page)
Abstract(in English) To promote the use of data, the data should be legally protected as intellectual property. In views of the foregoing, an amendment to the Unfair Competition Act of Japan on May 23, 2018 adds the provisions of the protection of data, and the overview thereof is shown in this article. The civil remedies such as damages and injunction are allowed for unfair acquisition, use and disclosure of limitatively distributed data. The legal framework for the data protection is more or less similar to that of trade secrets under the Unfair Competition Act of Japan.
