| (in English) | Open Graph Protocol (OGP) has been increasingly widespread in the internet community such as social networking service, and the open graph meta tags allow to generate the title of the webpage, the image data, the description of a website and so on in another website. Herein I present legal analysis whether the generation of the digital data in a webpage with a hyperlink through OGP meta tags is based on a copyright license agreement in the framework of Japanese Civil Law. An offer to use the copyrighted work in a digital data set by OGP meta tags is transmitted to the webserver of the copyright owner through the hypertext transfer protocol in the browser of the terminal of an end user, and the webserver automatically accepts the offer through the OGP meta tags in the header, thereby forming the copyright license agreement. Website terms of use in the website would be construed as the Standard Terms and Conditions under the amended Japanese Civil Code, which came into force on April 1, 2020. | |
