Effects of lawyer's argument on deliberation process in mock trial

To examine the impact of the defense attorney’s final argument in the Saiban-in system, a mock saiban-in deliberation which was participated by 24 undergraduates as lay judges and 3 law-school graduates as professional judges was conducted. The deliberations were based on one of the two scenarios which include different final arguments (story type or story and logic type). The purpose of this research is to examine the presence or absence of the impact of argument, and its reason through the analysis of the frequency and the contents of reference to the argument in deliberation. As a result, the saiban-in referred to the argument only about 1.83 times in a deliberation. The contents of reference were the “evaluation of the reality of the defense story,” “confirmation of the defense claim,” and “reference to the legal standard in the defense claim.” The result suggests that the impact of the final argument has an extremely light impact on the jury’s decision making except offering judgmental standards. |
