Underpinned by advancements in packet and broadband technologies, network convergence denotes the ability of different physical network infrastructures to convey functionally similar services. This resulted in the ‘de-lamination’ of application service from physical networks. A new market structure is emerging: physical network operators are becoming provider of physical access, transmission and connectivity, while multimedia applications are supplied by independent service providers. This paper examines the major regulatory implications of network convergence. First service-network delamination magnifies the importance of ensuring third party access to the last mile; yet the lowered entry barriers also implies the application and validity of essential facility test on access network needs to be reassessed. Second the emerging business model for providing universal connectivity renders some conventional rationales to regulate inter-operator interconnection obsolete. As such, an ex post approach is preferred. |
